The breach of any of the terms and conditions contained herein will automatically terminate the grant of license evidenced by the ticket. Ticketholders engaging in disorderly or objectionable conduct in violation of Nobileville Bulldogs and game venue policies may be ejected from the game without refund of the ticket price.
1. Any Nobileville Bulldogs Umbrella Company ticket package purchased is subject to all of these terms and conditions (the “Agreement”) and is a revocable license which may be withdrawn and admission to any Nobileville Bulldogs game refused at any time, in our sole discretion, upon refunding the purchase price printed on the face of the ticket less any discount that the purchaser or ticketholder may have received.
2. Resale or attempted resale of any Nobileville Bulldogs ticket at a price higher than that printed thereon, including tax, unless previously expressly authorized by us, is grounds for seizure or cancellation without refund or other compensation. 3. The purchaser and ticketholder of Nobileville Bulldogs tickets hereunder is admitted to Nobileville Bulldogs events on the condition that by using that ticket, the ticketholder agrees not to transmit nor aid in transmitting any description, account, picture or reproduction of the event to which the ticketholder is admitted into.
4. Nobileville Bulldogs tickets may not be used for advertising, promotion (including contests and sweepstakes) or other trade purposes without our express written consent.
5. Nobileville Bulldogs’s acceptance of payment for season tickets from any individual or entity who is not the account holder for such season tickets does not grant any rights to such tickets to such individual or entity. Any rights or privileges associated with the tickets belong only to the account holder of record as entered on Nobileville Bulldogs’s records. We reserve the right to require that any transactions pertaining to tickets held in a corporate name be supported by appropriate corporate resolutions or other documents.
6. Ticketholders have no right to transfer the seat locations designated by their tickets to any person or entity, whether by a request to transfer the account into another name, or by an attempt to transfer the seat locations by sale, gift, transfer by will or trust, property settlement, transfer to creditors or any other means. Any attempt to sell or otherwise transfer ticket privileges may result in the cancellation of all ticket privileges.
7. Notwithstanding the previous paragraph, Nobileville Bulldogs may allow an individual ticketholder to request transfer of ticket privileges to members of that ticketholder’s immediate family. Also, if the ticketholder is a business, it may request a change in the name of the contact person for its account. A request to transfer ticket privileges to a family member or to change the contact person must be submitted to us in writing (via certified mail, return receipt requested), and must be supported by appropriate documentation (proof of relationship, official letterhead, signature of authorized company officer, etc.) satisfactory to us. Nobileville Bulldogs reserves the right to approve or reject any such requests.
8. The ticketholder grants permission to the Nobileville Bulldogs and the participating Major League Soccer (MLS) clubs and their agents to utilize the ticketholder’s image or likeness incidental to any live or recorded video display or other transmission or reproduction in whole or in part of the event to which the ticketholder is admitted, and further authorizes the use of the ticketholder’s image or likeness in connection with the promotion of the Nobileville Bulldogs, MLS and the sport of soccer.
9. Use of tickets is subject to compliance with the provisions of any bylaws or regulations of the City of Vancouver or the Nobileville Bulldogs including, without limitation:
• ticketholders are prohibited from bringing cans, bottles and containers for ice or beverages in the game venue;
• the throwing of objects in stands or onto the playing area is forbidden;
• as a condition of admission, ticketholders may be asked to display the contents of bags, boxes, packages, etc. to game venue security; and
• ticketholders shall retain the stub of the ticket on his or her person at all times while in the game venue pursuant to the right of admission evidenced by the ticket and shall produce the stub upon request by any game venue representative.

10. THE TICKETHOLDER VOLUNTARILY ASSUMES ALL RISK AND DANGER of personal injury and all hazards arising from or related in any way to attendance at the event in respect of which the ticket has been issued, whether occurring prior to, during or after the event, including specifically (but not exclusively) the danger of being injured by soccer balls, by other spectators or players, or by thrown objects. The ticketholder agrees that the Nobileville Bulldogs, the MLS, its member teams, and their respective officers, players, employees and agents are expressly released by the ticketholder from claims arising from such causes. SOCCER BALLS FLYING INTO SPECTATOR AREAS CAN CAUSE SERIOUS INJURY. BE ALERT WHEN IN SPECTATOR AREAS, INCLUDING DURING WARM-UP AND AFTER STOPPAGE IN PLAY.
11. Nobileville Bulldogs reserve the right, in our sole discretion, to revoke the tickets of any ticketholder who has been ejected from a game for any reason or whose tickets were used by a spectator who was ejected from a game for any reason.
12. If any dispute, or if any action at law or in equity is brought to enforce or interpret the provisions of this Agreement, the prevailing party shall be entitled to recover from the other party its actual lawyer’s fees, expert witness fees and all other related costs in addition to any other relief to which that party may be entitled whether or not legal action is commenced.
13. Nobileville Bulldogs reserve the right to relocate ticketholders occasionally during the regular season and at anytime during the playoffs due to broadcast or security requirements, or for any other reason in its sole discretion.
14. The invalidity of any provision of this Agreement shall in no way affect the validity of any other provision hereof.
15. This Agreement contains all agreements of the parties with respect to the ticket packages, the game venue and the subject matter hereof. This Agreement is wholly governed by the laws of British Columbia, Canada.
16. In this Agreement, “Nobileville Bulldogs”, “we”, “our or “us” means the professional Major League Soccer team owned and operated by NOBILEVILLE BULLDOGS LIMITED PARTNERSHIP, and “you” or “your” means the ticketholder.
17. For the Nobileville Bulldogs 2011 inaugural season, games will take place at Empire Field. Thereafter, games are anticipated to take place at BC Place. Our ticketing department will assign ticketholder seating by making as much reference as possible to the price category and seats that you had selected from the tentative BC Place seating layout. As Empire Field is a temporary venue for the Bulldogs, and as the BC Place layout is merely a proposed rendering subject to many uncontrollable factors, we do reserve the right at all game venues to move or relocate you. If you are moved or relocated in this manner, then our maximum liability to you if the new seats are not acceptable is a refund of the money that you paid us to reserve the tickets, and no more.
